Welcome to Fit Flux! By accessing or using our website, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Fit Flux ("we," "us," or "our") is operated by an independent developer based in Richmond, British Columbia, Canada.

1. Medical Disclaimer (CRITICAL)

• Consult a Professional: Always seek the advice of your physician, physical therapist, or other qualified health provider with any questions you may have regarding a medical condition or before starting any new fitness program.
• No Doctor-Patient Relationship: Use of this Service does not establish a doctor-patient relationship between you and Fit Flux.
• AI Limitations: This Service utilizes Artificial Intelligence (AI) to generate suggestions. AI can make errors. You are responsible for verifying all information and ensuring any exercises are safe for your specific condition.

2. Eligibility and Account Registration

• Age Requirement: You must be at least 18 years old to create an account.
  • Note for Clinicians: If you are a Clinician using the Service to manage clients, you represent that you have obtained all necessary legal consents (including parental consent) to input data for any clients under the age of 18.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials (via Firebase Auth) and for all activities that occur under your account.
• Accuracy: You agree to provide accurate, current, and complete information during registration.

3. User Roles and Responsibilities

3.1. Solo Users (Athletes/Individuals)

• You acknowledge that you are using the Service to track your own fitness and rehabilitation progress.
• You assume full risk for any injuries or damages resulting from the exercises performed.

3.2. Clinicians (Coaches/Therapists)

• You are responsible for ensuring that your use of the Service with your clients complies with all applicable laws and professional regulations (including HIPAA, PIPEDA, and GDPR where applicable).
• You bear sole responsibility for verifying the accuracy of AI-generated programs before prescribing them to clients.

4. Subscription and Payments

• Billing: Some features of the Service are billed on a subscription basis.
• Changes: We reserve the right to change our pricing or subscription models at any time. Notice will be provided before any price changes affect your account.
• Cancellations: You may cancel your subscription at any time. Access to paid features will continue until the end of the current billing cycle.

5. Intellectual Property

The Service and its original content (excluding user-generated data), features, and functionality are and will remain the exclusive property of Fit Flux. The "Fit Flux" name and logo are trademarks of the developer.

6. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in that policy.

• Data Ownership: You retain ownership of the data you input (e.g., your workout logs, client lists). You grant Fit Flux a license to host, store, and process this data to provide the Service.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Limitation of Liability

To the maximum extent permitted by applicable law (including the laws of British Columbia), Fit Flux and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall Fit Flux's aggregate liability exceed the greater of one hundred Canadian dollars ($100 CAD) or the amount you paid Fit Flux, if any, in the past six months.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
